1. Introduction

Welcome to AfroGida ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website and mobile application (collectively, "Service") and form a binding contractual agreement between you, the user of the Service, and us. By accessing or using the Service, you agree to be bound by these Terms.

2. User Accounts

When you create an account with us, whether as a Customer or a Vendor, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your password and for any activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. The AfroGida Service

AfroGida is a platform that connects users ("Customers") with independent third-party providers of goods and services ("Vendors"). You acknowledge that AfroGida does not itself prepare food, sell goods, or provide services listed by Vendors. We are an intermediary technology platform that facilitates transactions between Customers and Vendors.

3.1. For Customers

You may place orders for goods or services from Vendors. All orders are subject to acceptance by the Vendor. A contract for the supply of goods or services is formed between you and the Vendor. We are not a party to this contract.

3.2. For Vendors

By listing your products or services on AfroGida, you agree to fulfill orders placed by Customers in a timely and professional manner. You are solely responsible for the quality, safety, and legality of the items you provide. You agree to pay a platform fee on completed transactions as outlined during your onboarding process.

4. Payments and Fees

Customers pay for orders through the Service. AfroGida facilitates these payments. For certain payment methods (e.g., Bank Transfer, E-Wallet), payment confirmation is required before an order is processed. Vendors receive their earnings minus the agreed-upon platform fee, which covers the costs of running the platform, marketing, and payment processing.

5. User-Generated Content

Our Service may allow you to post content, including reviews, classified ads, and job listings ("User Content"). You retain all of your rights to any User Content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service. You are solely responsible for your User Content and you expressly agree to exonerate us from any and all liability that may arise from it.

6. Prohibited Activities

You may not use the Service to engage in any illegal activities, infringe on the rights of others, post false or misleading information, or interfere with the operation of the platform. We reserve the right to suspend or terminate accounts that violate these terms.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AfroGida or its directors be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to the use of or inability to use the Service. Our liability is limited to the amount of the platform fee paid in connection with the transaction giving rise to the claim.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
